Allahabad High Court has dismissed a writ petition filed by Hindu Mahasabha leader Ashok Kumar Pandey, who had sought the dismissal of an FIR against him over his controversial remarks made against Aligarh Muslim University (AMU).
The Court also dismissed his writ seeking a stay on his arrest which is mentioned in the FIR, during the pendency of proceedings and investigation of the case.
Pandey in an interview had labelled Aligarh Muslim University as a “classroom of terrorists” and branded its founder Sir Syed Ahmed Khan as a “traitor”.
The FIR lodged against Pandey cited offences under Sections 153-A (punishment for persons who indulge in wanton vilification or attacks upon the religion, race etc. of others), 153-B (Imputations, assertions prejudicial to national integration), 505(2) (statements creating or promoting enmity, hatred or ill-will between classes) of the Indian Penal Code.
Considering the allegations to be correct and under investigation until proven based on the FIR, a Division Bench of Justices Manoj Kumar Gupta and Rajendra Kumar denied granting approval to the petition filed by Pandey. However, such a petition cannot be entertained at this stage of the case.
